Within the framework of promoting its products and services, the company under the name “EVEREST SOCIÉTÉ ANONYME HOLDINGS AND INVESTMENTS” organised a rewards, loyalty, and benefits program under the name “Everest Bite Club” (hereinafter referred to as the “Program”).
To be registered as a member of the Program, it is recommended that you have also been registered as a user on either the Website https://www.everest.gr (hereinafter referred to as the “Website”) or the relevant smart phones app (hereinafter referred to as the “Application”). Therefore, when registering it is recommended that you have read and accepted the terms of Use of the Website, the Application, their Personal Data Protection Statement https://www.everest.gr/privacy-policy/ and their Cookies Policy.
The present terms govern the use of the Everest Bite Club Customer Reward Program of Everest, and in particular the procedures relating to the acquisition and redemption of the Program Points and benefits by the participants (hereinafter referred to as “Members” or “Participants”).
Registration in the Rewards, Loyalty, and Benefits Program
The Everest Bite Club Program (hereinafter referred to as the “Program”) is the rewards and loyalty program of Everest A.E. for its loyal customers.
More specifically, in order for a customer of Everest to participate in the Program, he has to be registered through the available registration channels. Once the user has confirmed his registration, he can start using his membership number (the mobile phone number he has entered when registering) in every purchase through the everest points of sale participating in the Program as well as in online orders through the Website and the Application and collect bites (hereinafter referred to as “Points”).
You can register in the Program as follows:
The user can register in the Program for free through the Website (www.everest.gr) by entering his Name, Surname, e-mail address and the valid mobile phone number he wants to use as an ID (Loyalty Id), which he confirms by entering the confirmation code he receives by SMS or Viber message (no charge for the user) in the corresponding field.
The user can register in the Program for free through the Application (everest App) by entering his Name, Surname, e-mail address and the valid mobile phone number he wants to use as an ID (Loyalty Id), which he confirms by entering the confirmation code he receives by SMS or Viber message (no charge for the user) in the corresponding field.
The user can register in the Program by sending a text message (SMS) writing “EVEREST Name Surname” with a charge of 0.11€/SMS including VAT to the five-digit code number 19129, with which (SMS) he gives his consent to participate in the Program. Only one SMS is required for the registration.
The user can register in the Program for free at the everest stores participating in the program by giving his mobile phone number to the cashier. The cashier enters the number in the special field and if the user is not found as a registered member, he receives a registration request by SMS. To complete the registration, the user shall follow the link provided by the SMS and fill in his name, surname, and e-mail address. The user may activate his registration within one (1) week. After the one-week deadline has passed, if the user wishes to register in the Program, he will have to start the process from the beginning.
The user will be able to register in the Program through the tablets provided from time to time at the stores participating in the Program. To be registered in the program, the user shall fill out a special form with his mobile phone number, his name, surname, and e-mail address. Regarding the mobile phone, it is clarified that the user will have to confirm it by entering the confirmation code he receives by SMS (no charge for the user) in the corresponding field.
In case of registration in the Program from an Everest store, it is clarified that the member will not automatically become a user of the Website or/and the Application. In this case, he will have all the benefits and privileges of the Program except those provided exclusively through the Website or/and the Application (e.g., monitoring the points or coupons collected or the redemptions).
The type of the users-members’ personal data collected, the way in which they are collected and processed as well as the purpose for which they are processed are mentioned among others in the Personal Data Protection Statement, the content of which every member-user must have read and accepted.
Every natural person may be a member of the Program under the following conditions:
To be a permanent resident of Greece, regardless of nationality, age, gender, and occupation.
To have legal capacity
To enter a valid mobile phone number, full name, and a valid e-mail address, which he legally owns.
To have confirmed his mobile phone number. Participants may at any time during the Program update their profile on the Program’s website (www.everest.gr) in case their personal information changes.
The purchase of products is not mandatory for the registration in the Program.
If an Everest customer chooses to become a member of the Program, he will receive the following benefits as long as he states that he is a member of the Program by giving his mobile phone number when making a purchase either at any physical store participating in the Program or through the Website or/and the Application:
Description of the Rewards, Loyalty, and Benefits Program
The Program has a start date in November 2019 and is not governed by a fixed end date. In any case, Everest reserves the right to modify or terminate the Program at any time.
The Program shall be valid throughout each calendar year and refer to the purchases made either through the Website https://www.everest.gr or through the application (Everest app) or from the physical stores participating in the Program. The Program may also refer to and integrate Competitions, lotteries, and participation in various activities, which shall be clearly indicated on the Website or/and the Application. Everest reserves the exclusive right to add, subtract and modify in general the steps required to obtain a certain number of points.
Once the user requests to register in the Program, the points from his transactions are entered in his file and credited to his account upon successful completion of his registration. In case the user remains pending and is deleted from the database, these points are “lost” as well.
By registering in the Program, users give their consent to have their profile analysed (profiling) by Everest and be classified into segments (custom audiences). Within this framework, users are asked during their first login to the Website or/and the Application to fill out a questionnaire in order to earn extra bites. Filling out this questionnaire is indicated as a mission and is optional for the members. However, through this process, members will receive personalised offers either by e-mail, or SMS or social media remarketing (e.g., Facebook). These campaigns may be automated and triggered by the user's actions (e.g., second order, birthday, inactive for x time period) or ad hoc (e.g., Black Friday).
Collection of Points (bites)
In order to collect the bites (Points) of the Bite Club, it is necessary to be an active member of the Program.
Points are collected:
During the purchase of Everest products either through the Website www.everest.gr or through the Application (everest app) or from the physical stores participating in the Program.
During activities and interaction on the Website of the Program (www.everest.gr)
In order to collect points, it is necessary to show your personal membership number (Loyalty Id) before ordering. The membership number corresponds to the mobile phone number given by the user during his registration.
Each member may earn points for only three orders/purchases per day, and after the third order, points will be given only after checking.
For every purchase of 1€ by the member of the Program, the member earns 1 point (bite).
In order to further reward members, mechanisms may be activated during the Program, which may enable members to earn additional points (bites) as a reward for the successful completion of specific and clearly demarcated tests (e.g. successful registration, answering a number of questions, purchase of specific products, etc.), which will be clearly defined and regularly posted on the Website or/and the Application (missions).
Redemption of Points (bites)
Once a member has collected 10 points, they can be redeemed either for a gift voucher of one (1) euro (hereinafter referred to as “Gift voucher”) or for a participation in The Game (hereinafter referred to as the “Game”), which is accessible through the Website (www.everest.gr) and the Application (everest app). Either of the two options automatically excludes the other and the member cannot change his decision.
Once the member has collected 10 bites, he has the right to choose whether to take the Gift voucher or play the Game within 2 weeks . After the two-week deadline has passed, the member loses his right to redeem these points. Until the member makes his choice, the Gift voucher appears in his available coupons on the Website or/and the Application as well as in the Everest stores (POS).
- Gift vouchers and loyalty Coupons
Gift vouchers are activated 12 hours after they have been created and Loyalty coupons 20 minutes after they have been issued and can be redeemed at any everest store participating in the Program and by any redemption channel (physical store, Website, or Application) within two (2) weeks of their issue date, for the purchase of Everest products depending on their availability at the stores participating in the Program.
In each transaction, the member may redeem more than one Gift vouchers and Loyalty coupons. As long as the member has Gift vouchers and Loyalty coupons which have not expired, he may use them, provided that the total amount of his order/purchase is equal to or greater than the minimum order after the application of the Gift voucher(s) in each redemption channel.
The Program points are reset to zero every time the user collects 10 points and then he starts collecting them from the beginning.
Transactions made by redeeming Gift vouchers or Loyalty coupons are excluded from the collection of points.
If the user cancels his order, the points credited by that order are cancelled, or if the payment was made using coupons or Gift vouchers, they are returned to his account.
Each member of the Program may view his coupons, both active and non-active, through the Website or/and the Application. Each coupon shall display its description, unique code, status (active, expired, redeemed) and the terms of its use. Redeemed coupons shall display the redemption date instead of the expiration date.
- The Game
The Game is accessible through the Website or/and the Application. Everyone participating in the game wins a gift. Gifts are divided into two categories, third-party gifts (hereinafter referred to as the “Big gifts”), which are sent to the winners, and everest products (hereinafter referred to as “everest gifts”), which are given in the form of a loyalty – discount voucher.
The aim of the game is to find 5 hidden objects within 30’’. The game involves a number of gifts (everest gifts and big third-party gifts, such as TVs), which are drawn at various time points to those participating in the game.
Everyone participating in the Game wins a gift. Those, who have successfully found all hidden objects, will automatically have access to the big gifts, while the rest will only have access to “everest gifts.” Big gifts change every time and are communicated to the public through the Website and the Application as well as through personalised e-mails. Big gifts are randomly drawn through timestamp. Everest gifts (e.g., coffee, round sesame bread, croissants etc. free of charge) are given to those (a) who have not won the Game and (b) who have won and according to timestamp have not been drawn to any of the big gifts. Small gifts and the Game will be modified from time to time by Everest without prior notice. Lastly, it is clarified that the winners of the big gifts cannot be the same for two (2) consecutive draws.
Terms relating to the Draws
The employees of Everest, the Technical Contractor, and their affiliated companies, as well as the spouses and relatives up to the second degree are excluded from the big gifts draws of the month.
Each draw will be conducted through a specially designed software.
There is absolutely no human intervention in the drawing process. The participants (namely those who have won the game) are registered in the system of the Technical Contractor in order to be given the points and be checked but also to announce those having the right to participate in the draws and the winners.
Gifts are specific, personal and their respective value cannot be transferred and exchanged for money.
Apart from ensuring the gifts each winner has won, Everest and the Technical Contractor bear no other additional responsibility towards those participating in the draw. The responsibility of Everest and the Technical Contractor is limited solely to the disposal of the gifts, and they will not be subject to, or under any obligation towards the participants. After the draw and the distribution of the gifts to the winners, every obligation of Everest and the Technical Contractor ceases. Everest and the Technical Contractor will not be responsible for any actual defects, which may appear on the gifts, for which the winners of the Program, or any runners-up, should directly contact their manufacturers or related agencies. Gifts, which will be delivered under the present terms, are provided in the state in which they are, excluding the application of the provisions on the seller’s liability or other provisions establishing liability in relation to actual defects, agreed properties, etc., against Everest or the Technical Contractor. In full repayment of any claim by a winner regarding actual or other defects and instead of payment (pro soluto), it is agreed that Everest or the Technical Contractor (by order and on behalf of Everest) will assign any factory or other warranties of the manufacturer accompanying the corresponding gift to the winner at his request in writing, if any. In any case, the liability of Everest or the Technical Contractor shall be limited to acts or omissions due to wilful misconduct or gross negligence and shall under no circumstances extend to any accidental events or events of force majeure occurring to any of them. Everest shall also bear no responsibility, criminal or civil, towards any winner or third party, for any accident or/and body injury or/and damage to be caused to them directly or indirectly related to the gifts. Furthermore, Everest and the Technical Contractor shall not be liable for any failure or delay in receiving or registering a participant by the system of the Program due to technical reasons, force majeure, or errors of any nature.
Everest reserves the right to modify the number and type of gifts at its discretion. The winners will receive their gift at a place and time specified by Everest and the Technical Contractor, upon presentation of their police-issued ID or any other official document allowing the verification – identification of the details provided during the telephone contact with Everest. If the winner is a minor and does not have such a document, the gift will be delivered to one of his guardians.
Everest reserves the right to announce the winners of the draws through the Website, the Application, and its social media accounts. By participating in the Game and the drawing, members give their explicit and unconditional consent regarding the above-mentioned announcement of the winners.
Deletion process from the Program
The user may at any time delete his account either by sending an email to contact-us@everest.gr or through his profile on the Website. It is explicitly pointed out that if any of the members of the Program chooses to be deleted from the Program, he will automatically be deleted from the Website or/and the Application as well, as long as he had been registered.
Accounts, which have been inactive (that is, they have not made any order) for more than two (2) years, will be automatically deleted.
Before deleting the account, Everest has the right to inform its members of the forthcoming deletion of their account.
Account deletion is defined as the anonymisation of the user's personal data (full name, address, phone number, etc.). Data, which cannot be associated with a particular user (purchased products, city, etc.) remain on the database of Everest for statistical purposes.
General Terms
The number of Points, the Gift vouchers, the Loyalty coupons, and the Gifts are strictly personal and cannot be exchanged for money.
Everest reserves the right to unilaterally amend the reward system and readjust or replace the way Points are being calculated as well as the amount, with which purchases are rewarded.
Everest has the right to unilaterally amend any of the terms of the present, including the way points are being calculated as well as the amount or even the way, in which purchases are rewarded. Any such amendment shall be communicated in advance to the members by all appropriate means through the contact details provided during their participation in the Program or by posting any amendment on the Website or/and the Application. Everest reserves the right to modify or terminate the Program at any time, after the prior written notice to the members of the Program.
In case Everest amends part or all the terms of the Program or terminates the benefits Program, the members shall not have any claim against Everest, since they already recognise that it is a benefits Program provided by way of donation by Everest.
Everest reserves the right to cancel or/and terminate the participation of a member of the Program at any time, in case of misuse or attempted deception by the member. In this case, all the Points and Gift vouchers acquired will be immediately deleted.
Members, who are registered in the Program, are obliged to accept the newsletters, and offers so that we can serve the purposes of the Program (sending Gift vouchers and coupons earned by the user by collecting points as well as exclusive offers only for members). However, members have the right to choose by which means they will receive newsletters and offers exclusively through the Website.
Everest reserves the right to inform members individually by email or mobile message (SMS or Viber).
Everest considers that the person taking part in the Program is the holder or has the legal and unconditional approval and explicit authorisation of the holder of the SIM card corresponding to the mobile phone number, with which he participated in the Program. Sending an SMS under the present terms implies the unconditional acceptance of these terms by the Participant. In particular, the Participant shall accept the reception of informative messages for the promotion of this particular Competition and for as long as this Competition lasts.
The present terms and any kind of contractual and non-contractual relationships arising during their application shall be governed by the Greek law. Any dispute regarding the Program that may arise shall be submitted to the exclusive jurisdiction of the Courts of Athens.
Everyone has the right to receive a true copy of the present participation terms with diligence and at his own expenses by sending an e-mail to contact-us@everest.gr.
Participation in the Program shall be interpreted as the unconditional acceptance of the above-mentioned participation terms.
